Following a series of lawsuits launched by former Lucent (the Bell Labs guys), former Alcatel and now also the newly formed Alcatel-Lucent, now we have in a San Diego court one woman and eight men to decide on the fate of mp3.

The technology behind mp3 (MPEG1 layer 3), although originating from the German based Frauenhoffer Institute was developped in cooperation with Bell Labs, which at that time was part of Lucent and now of Alcatel-Lucent.

The claim is now that Microsoft, despite being warned several times, decided to go ahead and implement the patented technology in some of it’s products. Their counterclaim is that they already license rights through France based Thomson SA from the Frauenhoffer Institute.

Should however Alcatel-Lucent be awarded the rights they claim, this means the entire industry is on the brink of massive onslaught. Virtually any tech company uses mp3 in one place or another.

Is this the moment everybody will turn to AAC or ogg? Who knows, but depending on the outcome of this trial we may be in for a though ride. And is Microsoft going to experience a rude awakening from their multimedia dreams?
